“DO OUR COMPANY NEEDS TO CONTRIBUTE FOR HRDF LEVY?”

Recently we have few customers asking us about “Do our company needs to contribute for HRDF Levy?”
As last year, HRDF/PSMB have announce about the Expansion of the Pembangunan Sumber Manusia Bhd (PSMB) Act 2001 to more SMEs of 19 new sub-sectors within the Manufacturing, Services and Mining & Quarrying sectors that employ a minimum of 10 local employees, which is already take in force since 1 April 2017, and HRDF do give a six-month grace period until 30 September, 2017.
Our customers tell us that they are not so sure are they liable to register and contribute for the HRDF levy.
I wish to share in this info with you that you might want to know as your company/subsidiaries or your friends wish to know more about it.
Herewith I have list down 3 conditions for this topic, which is:
- For those who are not sure
- For those confirm and know that their company are liable
- For those liable but not yet register and not yet contribute for HRDF Levy
1) FOR THOSE WHO ARE NOT SURE, PLEASE DO THIS:
Go to HRDF Portal, https://www.hrdf.com.my > Services > Registration of Potential Liable Employer. Fill up the online form and attached the documents as required. The PSMB staff will check and informed you whether your company is liable or not.

2) FOR THOSE CONFIRM AND KNOW THAT YOUR COMPANY ARE LIABLE
Go to HRDF Portal, https://www.hrdf.com.my > Services > Registration of Liable Employer > Amendment & Expansion Of PSMB Act 2001. There will have all the information, guidelines and forms for your registration.
Shall you wish to register online, you can go to HRDF Portal https://www.hrdf.com.my > on the side bar, click on “New Registration”> at the right side there is “Checklist” and Additional Info to assist you > Read the Steps and click “Here” for the online forms and fill up.
After the submission, you shall wait for the approval from HRDF and their instruction.

3) LIABLE BUT NOT YET REGISTER AND NOT YET CONTRIBUTE FOR HRDF LEVY
This will be the legal consequences for those who are liable but not register. Any employer who is convicted for not registering with PSMB may be fined up to an amount not exceeding RM10,000 or face imprisonment up to a year, or both (Section 13 (2)).
HRD levy is to be made no later than the 15th date of the month in which the payment falls due, as stated under Regulation 8(1) of the Pembangunan Sumber Manusia Berhad (Registration of Employers and Payment of Levy) Regulations, 2001.
Failure of payment application before the stipulated time will result in;
- Fined not exceeding RM20,000.00 (Ringgit Malaysia Twenty Thousand) or to imprisonment for a term not exceeding two (2) years or both (on conviction)
- Yearly interest of 10 per cent in respect of each day of default or delay in payment
